Welcome to Brushfeed. These Terms of Service ('Terms') govern your use of our social media scheduling and publishing platform ('Services') operated by Oneforge Ltd. ('we', 'us', or 'our'), a company registered in the United Kingdom.

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.

These Terms apply to all users of our Services, including without limitation users who are browsers, creators, artists, and contributors of content.

Brushfeed is a social media scheduling and publishing platform built for artists and creative professionals. Our Services include:

• Social media content scheduling and publishing across Instagram, Pinterest, TikTok, and DeviantArt

• AI-powered caption enhancement, hashtag generation, and Artistic DNA analysis

• Analytics and engagement insights for connected platforms

• Multi-platform account management and content calendar

• Media upload and management

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice.

To use Brushfeed, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activities that occur under it.

New users receive a 14-day free trial with full access to all features. No payment method is required to start a trial.

Each email address is entitled to one free trial only. If you sign up with an email that has previously been used for a trial, you will not receive another trial period.

You must be at least 16 years old to create an account. If you are under 18, you must have parental or guardian consent to use our Services.

After your free trial, a paid subscription is required to continue using Brushfeed. The standard subscription price is £12 per month, though promotional pricing may be available from time to time.

Subscriptions are billed monthly via Stripe. By subscribing, you authorise us to charge your chosen payment method on a recurring basis.

You may cancel your subscription at any time through the customer portal, accessible from your account settings. Cancellation takes effect at the end of your current billing period.

If a payment fails, your account status will change to past due. You will need to update your payment method to restore access.

All fees are in British Pounds (GBP) and are exclusive of applicable taxes, which will be added to your bill as required by law.

We reserve the right to change our pricing with at least 30 days' notice. Existing subscribers will be notified by email before any price changes take effect.

Brushfeed includes AI-powered features such as caption enhancement, hashtag generation, and Artistic DNA analysis. These features are provided via AWS Bedrock (Anthropic Claude).

When you use AI features, your post content (captions, hashtags) is sent to AWS Bedrock for processing. This data is processed in the EU (eu-west-1) and is not stored or used for training by the AI provider.

AI features are subject to monthly credit limits. Each subscription includes 100 AI credits per month, which reset at the start of each billing cycle.

AI-generated suggestions are provided as-is. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content. You are responsible for reviewing and approving all content before it is published.

Brushfeed connects to third-party social media platforms via OAuth. By connecting a platform, you authorise Brushfeed to post content, read analytics, and manage your account on that platform on your behalf.

We store OAuth access tokens securely to maintain your connections. You can revoke access to any connected platform at any time from your account settings.

Your use of connected platforms is subject to their respective terms of service. We are not responsible for changes to third-party platform APIs, policies, or availability that may affect our Services.

You retain full ownership of your artwork, images, videos, captions, and all other content you upload to or create through Brushfeed. We do not claim any intellectual property rights over your content.

By using our Services, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing our Services (e.g., scheduling and publishing your posts).

You represent and warrant that you have all necessary rights to the content you upload and that it does not infringe upon any third-party rights.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

We comply with the UK General Data Protection Regulation (UK GDPR) and other applicable data protection laws.

We implement appropriate technical and organisational measures to protect your data. For full details on what we collect, how we use it, and your rights, please refer to our Privacy Policy.

You agree not to use our Services to:

• Distribute spam or unsolicited bulk content across connected platforms

• Post content that is illegal, harmful, threatening, abusive, or violates third-party rights

• Abuse AI credits through automated or excessive usage beyond normal creative workflows

• Attempt to gain unauthorised access to our systems, other users' accounts, or connected platforms

• Interfere with or disrupt the operation of our Services

• Circumvent any usage limits, trial restrictions, or access controls

We reserve the right to investigate violations and may suspend or terminate accounts that breach this policy.

To the maximum extent permitted by law, our liability for any claims arising from your use of our Services is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities.

We are not liable for any issues caused by third-party platforms, including API changes, downtime, or policy changes that affect our ability to provide our Services.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

You may cancel your subscription and delete your account at any time from your account settings.

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our Services.

Upon termination, your right to use our Services ceases immediately. We may retain certain data as required by law or as described in our Privacy Policy.

We may update these Terms from time to time to reflect changes in our Services or applicable laws.

We will notify you of any material changes by posting the updated Terms on our website and, where appropriate, by email.

Your continued use of our Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you should stop using our Services.

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms or your use of our Services will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may have additional rights under consumer protection laws that cannot be excluded by these Terms.
